Mandatory Request to NHS Digital; estates and facilities data collection
A mandatory request that NHS Digital establish and operate a system for the collection and analysis of information related to the NHS estates and facilities management, in particular the Estates Return Information Collection (ERIC), on behalf of NHS Improvement's estates and facilities management Team.
In accordance with the Health and Care Act 2022 and the Health and Care Act 2022 (Commencement No. 2 and Transitional and Saving Provision) Regulations 2022, as of 1 July 2022 Monitor (NHS Improvement) was abolished.
All mandatory requests from Monitor (NHS Improvement) were to be treated as a direction by NHS England to NHS Digital under section 254 of the Health and Social Care Act 2012.
Subsequently, on 1 February 2023, the statutory functions of NHS Digital transferred to NHS England under the Health and Social Care Information Centre (Transfer of Functions, Abolition and Transitional Provisions) Regulations 2023 (Transfer Regulations). Under these Transfer Regulations, all directions from either the Secretary of State for Health and Social Care or NHS England to NHS Digital are now treated as directions from the Secretary of State for Health and Social Care to NHS England.
Purpose
Understanding how providers spend money is essential in tackling short-term deficits; supporting the development of new models of care and reducing the variation in resource utilisation. The information gathered from this programme will be used to enable NHS Improvement to perform its costing and licensing functions under the HSCA more effectively.
Legal basis
This request meets the requirements for a mandatory request under section 255(4) of the Health and Social Care Act 2012. Prior to making this request, NHS Improvement EFMT has liaised and worked with NHS Digital as required by 257(4) of the HSCA
