Data services for commissioners Directions 2015
Directions given by NHS England requiring NHS Digital to establish and operate systems for the collection and analysis of local commissioning data, clinical registry data and historic Primary Care Trust (PCT) data to deliver data services for commissioners.
This Direction and associated documents make reference to Clinical Commissioning Groups (CCGs).
In accordance with the Health and Care Act 2022 and the Health and Care Act 2022 (Commencement No. 2 and Transitional and Saving Provision) Regulations 2022, as of 1 July 2022, CCGs are abolished and their statutory obligations will be managed by Integrated Care Boards.
These obligations include all continuing requirements, including those to submit data to NHS Digital as set out in this Direction and associated documents.
Purpose
Commissioners of healthcare services need to plan and commission healthcare services in their local area through analysis of actual and projected use of services. As commissioners do not provide direct patient care, they have no legal basis for accessing personal confidential patient information. Therefore, commissioners require an intermediary service that specialises in processing, analysing and packaging patient information into a format they can legally use. This intermediary service is provided by the Data Services for Commissioners programme.
Legal basis
Sections 254(1), (3) and (6), 260(2)(d), 261(3), 262(3)(a) and (b), 262(7) and 304(9), (10), (11) and (13) of the Health and Social Care Act 2012.
The Directions came into force on 10 August 2015.
