National data opt out Direction 2017
A Direction given by the Secretary of State for Health requiring NHS Digital to establish and operate a system for the collection and analysis of information, and to exercise such systems delivering functions, in respect of the new national opt-out model.
Purpose
To support the Secretary of State for Health's commitment to support the National Data Guardian's (NDG) review of data security consent to opt out.
This Direction supplements the Patient objections Directions 2015 and has been supplemented by the National data opt out Direction 2018.
The Patient objections (type 2) Directions 2016 have been withdrawn.
Legal basis
Sections 254(1), (6), 274 (2) of the Health and Social Care Act 2012.
The Direction came into force on September 2017.
