NEMs provides message brokering for a publishing organisational data controller to one or more subscribing organisations, also data controllers, however, the publishing organisation does not necessarily know who the receiving organisations are, as this is handled by NEMs subscriptions.

To provide the necessary visibility to all organisations, we publish a controller catalogue which lists all the organisations using the service.

Sometimes Caldicott Guardians in organisations will query the legal basis on which the information is being exchanged. For many of the messages on NEMs, this will be the Section 7A for NHS England (NHSE) to meet its legal obligations to the Sectary of State pursuant to s7A NHS Act 2006 as amended by the Health and Social Care Act 2012.

To help organisations understand the basis on which different messages are exchanged, we have also provided a legal basis, which explains who publishes and who can receive each message and on what basis they do so. You can request a copy of this document by emailing the NRL NEMS team.
