1 February 2023: The statutory functions of NHS Digital transferred to NHS England under the Health and Social Care Information Centre (Transfer of Functions, Abolition and Transitional Provisions) Regulations 2023 (Transfer Regulations) with effect from 1st February 2023 (Transfer Date).
Under the Transfer Regulations, all directions by either the Secretary of State or NHS England to NHS Digital are now regarded as if they were directions made by the Secretary of State to NHS England.
Where NHS Digital was required to or previously accepted a request under section 255 of the Health and Social Care Act 2012 (2012 Act) to establish and operate an information system, that request is regarded under the Transfer Regulations as a request made to and accepted by NHS England.
Under the Transfer Regulations, all DPNs previously issued by NHS Digital under section 259 of the 2012 Act are regarded as DPNs issued by NHS England. All DPNs continue in force and all data collections required under them continue in force unless and until any DPN is amended or withdrawn. All DPNs issued by NHS England after the Transfer Date will continue to be published here.
30 June 2022: In accordance with the Health and Care Act 2022, as of 1 July 2022, CCGs are abolished and their statutory obligations will be managed by integrated care boards. These obligations include the continuing requirement to submit data to NHS Digital as set out in a DPN. This has been confirmed in communication with individual submitting organisations for relevant collections and the supporting notices will be formally updated on the next version of each collection.
Overview
When we receive a Direction or Request to collect information, we issue a DPN to the appropriate providers of the specified data. The DPN provides details of the data collection including:
- purpose
- scope
- form, manner and frequency
- what we are allowed to do with the data (publish, disseminate for example).
